DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement ("Agreement") is entered into between:

BUYER:

• The customer ("Buyer") who places an order for products listed on www.cabanatextile.com.

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with applicable consumer protection laws regarding the sale and delivery of products ordered electronically by the Buyer from the Seller's website.

3. PRODUCTS AND ORDER DETAILS

• Product Specifications: The descriptions, quantities, and features of the items are detailed on the product pages at the time of purchase.

• Pricing: The total price, including applicable taxes and shipping fees, is displayed at checkout before payment confirmation.

4. DELIVERY TERMS

• Shipping: Products will be delivered to the address provided by the Buyer during checkout.

• Delivery Time: Standard delivery is completed within [5–9 business days] from order confirmation, subject to stock availability and logistics delays.

• Custom / Personalised Items: Bespoke or customized textile orders may require additional processing time as specified on the product page.

5. RIGHT OF CANCELLATION & RETURNS

• Standard Return Window: The Buyer has the right to cancel or return standard products within 7 days of receiving the order without providing a reason, provided the goods are unused, unwashed, and in original packaging.

• Exceptions: In accordance with standard distance selling regulations, the right of cancellation does not apply to:

  • Custom-made, As-Is, personalized, or custom-monogrammed textile items.

  • Goods that have been used, washed, altered, or damaged after delivery.

• Return Shipping Fees: Return shipping costs are paid by Buyer.

6. DEFECTIVE OR DAMAGED GOODS

If a product arrives damaged, defective, or incorrect, the Buyer must notify the Seller within 48 hours of receipt along with photos of the damage. The Seller will arrange for a replacement or a full refund including shipping costs.

7. PAYMENT TERMS

• Payments are processed securely via available payment gateways on www.cabanatextile.com (e.g., credit card, debit card).

• Orders will be dispatched only after full payment authorization is received.

8. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of  United States. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Virginia Beach Virginia.

9. ACCEPTANCE

By completing a purchase on www.cabanatextile.com, the Buyer confirms that they have read, understood, and agreed to all terms stated in this Distance Sales Agreement.
